Acceptance of Terms
These Terms of Use govern access to and use of landleap.org. The site is operated by E.S. Entrepreneurship & Project Management LLC. In these Terms, “LandLeap,” “we,” “us,” “our,” and “the Company” mean that limited liability company. LandLeap is a brand of the Company, not a separate legal entity.
By using the website, you agree to these Terms. If you do not agree, do not use the site. Our Privacy Policy describes how the Company handles personal information.
These Terms cover the website. They do not replace a separate written agreement for the purchase or sale of a parcel. If a signed agreement and these Terms address the same transaction, the signed agreement and the law that applies to it control that transaction. These Terms do not override real estate contract law.
About LandLeap
LandLeap is the name the Company uses for its vacant-land business. The Company identifies land, acquires land from owners, markets land, and sells land to buyers. That work can include researching public property records, contacting owners, listing parcels on this website, answering inquiries, and completing a purchase or sale through the closing process that applies to the parcel.
These Terms do not state that the Company holds a brokerage license, a lending license, or any other professional license. Whether any license is required for a particular activity is a legal question that must be confirmed outside these Terms. Nothing on the website appoints the Company as your attorney, tax advisor, surveyor, or land-use consultant.
Website Information
Property information on this website is general information about parcels the Company is marketing or has marketed. It can include:
- Listing descriptions
- Asking prices
- Estimated acreage
- Maps
- Photographs
- Parcel boundaries
- Location information
- Utilities
- Road access
- Zoning information
- Whether a property is available
That information can be incomplete. It can change. It can contain mistakes. Some of it comes from public records, from prior owners, from site observations, or from other sources the Company did not create. Photographs can show a season, a viewpoint, or a nearby area, and they can include material the Company licenses rather than owns.
Maps, aerial images, and boundary drawings are approximate. They are not a survey, a legal description, or a substitute for the official records in the county where the land sits. Measurements on a map can differ from a recorded survey.
Where a listing shows owner-financing figures, those figures describe the plan published for that parcel. They are not a loan approval, a promise that the same plan will remain available, or an offer of credit until the Company confirms them in a written agreement for that parcel.
Independent Property Due Diligence
Before you commit to buy a parcel, you should investigate the facts that matter for the way you intend to use it. The items below are examples of what a buyer commonly needs to check. The right investigation depends on the parcel and on your plans.
- Legal ownership of the property
- The condition of title
- Recorded liens
- Property taxes
- A boundary survey
- Acreage
- Easements
- Legal access
- Physical access
- Road conditions
- Zoning restrictions
- Land-use regulations
- Building permits
- Water availability
- Sewer and septic requirements
- Electricity availability
- Flood zones
- Environmental conditions
- Soil conditions
- Homeowners’ association or deed restrictions
- Whether the land is suitable for your intended use
- The cost of any development you have in mind
County offices, a title company, a licensed surveyor, and other independent professionals are the right sources for those questions. Approximate maps and images on this website are not a substitute for a survey or for the official record.
This section asks you to do your own investigation. It does not waive a disclosure a seller is required by law to make. It does not excuse a false statement. It does not reduce a duty that a statute says cannot be waived. If website text and a signed purchase agreement differ, the signed agreement and applicable law control the transaction.
Property Availability and Pricing
Listings can change without notice. An asking price can change. A parcel can be reserved, sold, or withdrawn. A page on this website is not, by itself, a binding offer to sell a parcel at the price or on the terms shown there.
Confirm that a parcel is still available before you rely on a listing. Sending an inquiry does not reserve the land, and it does not mean a transaction will occur. Owner-financing figures, where they appear, remain subject to written confirmation for that parcel.
Offers and Purchase Agreements
Submitting an inquiry does not create a contract. Discussing a price, a down payment, or a closing date does not, by itself, create a purchase agreement. A binding purchase or sale is made through the written agreement for that transaction, signed by the parties the law requires, and completed through the steps that apply, which can include escrow, a deed, and recording.
Any transaction has to satisfy the legal requirements that apply to it. Those requirements depend on the state where the land is located and on how the deal is structured. These website Terms do not set the price, the deed, the financing, the closing conditions, or the remedies for a particular parcel. The signed purchase agreement does that, together with applicable law.
Seller Inquiries
A property owner may contact the Company about selling land. You can send a property address, parcel number, county, and other details you want us to see.
Sending that information does not obligate you to sell. It does not obligate the Company to make an offer. Any offer the Company makes can depend on further research. Title, ownership, access, condition, price, and other facts can change whether an offer is made and what it says. A binding sale still requires an agreement that is appropriate for that transaction. Until that agreement is signed, either side may decide not to proceed.
No Professional Advice
The website is general information about land the Company buys and sells. It is not a substitute for independent advice from professionals you select, including:
- A lawyer, for legal advice
- A tax advisor, for tax advice
- A financial advisor, for financial advice
- A surveyor, for surveying
- A title examiner or title company, for the condition of title
- An engineer, for engineering questions
- A planner or other qualified person, for zoning and land-use questions
You are responsible for getting the advice your situation requires. The Company does not create an advisory relationship with you by publishing a listing or by answering a question about a parcel.
User Responsibilities
When you use the website, you agree to:
- Provide information that is accurate to the best of your knowledge
- Use the website in compliance with law
- Avoid fraudulent inquiries or other submissions you know are false
- Respect the rights of other people, including their privacy and their intellectual property
- Refrain from interfering with the website, its hosting, or another person’s use of it
If you submit information about a parcel or about another person, you need a lawful basis to share it with us.
Intellectual Property
The Company owns or licenses the website content, the LandLeap name and logo, the site design, and the original text it publishes, except where a third party retains ownership. You may view the site for your own use in considering a possible transaction with the Company.
Maps, photographs, parcel data, and similar materials may belong to the people who created them or to the services that supplied them. Those owners keep their rights. These Terms do not transfer the Company’s intellectual property to you, and they do not transfer a third party’s intellectual property to you. You may not remove proprietary notices or present the Company’s materials as your own.
Prohibited Website Activities
You may not:
- Scrape the website, or use automated extraction, in a way that violates these Terms or another person’s rights
- Bypass access limits or interfere with the site’s operation, security, or availability
- Introduce malware or attempt unauthorized access
- Submit a fraudulent inquiry or impersonate another person
- Reuse the site’s content commercially without permission
- Misuse the Company’s or a third party’s intellectual property
The Company may block activity that violates this section. A block does not limit a remedy the law provides.
Third-Party Services
The website may link to independent services, including county record sites, mapping tools, and payment pages. Some listings link to MoonClerk so a buyer can make a payment the listing identifies. Those services are operated by other companies. Their terms and privacy policies govern the information you give them and the transactions you start on their sites.
We are responsible for our own statements on landleap.org. We do not control a third-party service, and we do not adopt its content as ours. This section does not disclaim a duty the law does not allow the Company to disclaim, and it does not shift responsibility for the Company’s own representations onto a third party.
Disclaimers
The website, including listings and other informational content, is provided on an “as available” basis for general information. To the extent the law allows, the Company disclaims warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement in connection with the website and its informational content. The Company does not warrant that the site will be uninterrupted or free of errors, or that third-party materials linked from the site are accurate.
This disclaimer has limits. It does not apply to fraud or intentional misconduct. It does not waive a disclosure the law requires the Company to make. It does not affect a right that cannot be waived. It does not rewrite a signed purchase or sale agreement.
Limitations of Liability
To the extent the law allows, the Company and its members, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of your use of the website or your inability to use it. This website limitation applies to claims about the site itself.
These Terms do not set a dollar cap on liability. They do not exclude or limit liability where the law does not allow that exclusion or limit. A claim about a specific parcel, a deed, a payment, or a signed contract is governed by that contract and by applicable law, rather than by this website limitation. Nothing in this section limits liability for fraud, intentional misconduct, or a duty a statute does not permit these Terms to limit.
Changes to the Website and Terms
The Company may update website content, including listings, prices, and availability. The Company may also update these Terms. When these Terms change, the effective date under the page title will change after the revision is approved for publication. If you continue to use the website after that date, the updated Terms apply to that later use, except where the law requires a different notice.
An update to these Terms does not amend a purchase or sale agreement that has already been signed.
Governing Law
These Terms do not select a governing law. They do not select a court, a venue, or a forum for disputes. The Beverly Hills mailing address is the Company’s business address. It is not a choice of California law. These Terms do not require arbitration, and they do not include a class-action waiver.
Severability
If a provision of these Terms is held unenforceable, that provision will be limited or severed only to the extent the law requires, and the remaining provisions will continue in effect. Where the law allows a court to reform an unenforceable provision so that it can be enforced, the provision may be reformed to that extent. This section operates only as applicable law allows.
